These Terms of Service govern your access to and use of TigerLabel's data labeling platform, services, and related tools. By accessing or using our services, you agree to be bound by these terms.
1Acceptance of Terms
By creating an account, accessing, or using TigerLabel's platform and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
Important Notice
If you do not agree to these Terms, you may not access or use our Services. These Terms include important information about your legal rights, including limitations on TigerLabel's liability and your obligation to arbitrate disputes.

2Description of Service
TigerLabel provides a cloud-based data labeling and annotation platform that enables organizations to create high-quality training data for machine learning and artificial intelligence applications.

2.2 Service Modifications
We reserve the right to modify, suspend, or discontinue any part of the Services at any time. We will provide reasonable notice of material changes that negatively impact your use of the Services. Continued use after such changes constitutes acceptance.
Beta Features
Some features may be designated as "Beta" or "Preview." These features are provided "as-is" without warranties and may not function as intended. We may change or discontinue Beta features at any time without notice.
3User Accounts
3.1 Account Registration
To use the Services, you must create an account by providing accurate, complete, and current information. You agree to:
- Provide accurate and truthful information during registration
- Maintain and update your account information to keep it accurate
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized access or security breach
- Be at least 18 years of age or the age of majority in your jurisdiction
3.2 Account Security
You are responsible for all activities that occur under your account. We strongly recommend:
- • Using a strong, unique password
- • Enabling multi-factor authentication (MFA)
- • Not sharing your credentials with others
- • Logging out from shared devices
- • Regularly reviewing account activity
TigerLabel is not liable for any loss or damage arising from your failure to maintain account security.
3.3 Organization Accounts
For organization accounts, the account owner has administrative control over:
- • Adding and removing team members
- • Assigning roles and permissions
- • Managing billing and subscriptions
- • Accessing organization data and analytics
- • Setting security and compliance policies
4Acceptable Use Policy
You agree to use the Services only for lawful purposes and in accordance with these Terms.
4.1 Prohibited Activities
You agree not to:
Illegal or Harmful Activities
- • Violate any applicable laws or regulations
- • Infringe on intellectual property rights
- • Upload content that is illegal, harmful, or offensive
- • Engage in harassment, hate speech, or discrimination
- • Distribute malware, viruses, or malicious code
Security Violations
- • Attempt to gain unauthorized access to the Services
- • Interfere with or disrupt the Services or servers
- • Circumvent security measures or authentication mechanisms
- • Probe, scan, or test vulnerabilities of our systems
- • Access data not intended for you
Abuse and Misuse
- • Use the Services to send spam or unsolicited communications
- • Engage in fraudulent or deceptive practices
- • Create fake accounts or impersonate others
- • Scrape, crawl, or harvest data without permission
- • Reverse engineer or decompile the platform
Resource Abuse
- • Use the Services in a way that burdens infrastructure
- • Exceed rate limits or usage quotas
- • Use the Services for cryptocurrency mining
- • Resell the Services without authorization
Consequences of Violations
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account, removal of content, and/or legal action. We reserve the right to investigate violations and cooperate with law enforcement.
5Intellectual Property
5.1 TigerLabel's Intellectual Property
The Services, including all software, technology, designs, graphics, user interfaces, trademarks, logos, and documentation (collectively, "TigerLabel IP"), are owned by TigerLabel, Inc. and protected by intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business purposes. You may not:
- • Copy, modify, or create derivative works of the Services
- • Reverse engineer, decompile, or disassemble the platform
- • Remove or alter any proprietary notices or labels
- • Use TigerLabel's trademarks without written permission
- • Frame or mirror any part of the Services
5.2 Feedback and Suggestions
If you provide feedback, suggestions, or ideas about the Services ("Feedback"), you grant TigerLabel a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such Feedback into our Services without any obligation to you.
Open Source Software
The Services may include third-party open source software components. Such components are licensed under their respective open source licenses, which may be found in our open source attribution documentation.
6User Content and Data
6.1 Your Data Ownership
You retain all ownership rights to the data, content, and annotations you upload, create, or generate using the Services ("Your Data"). TigerLabel does not claim ownership of Your Data.
Limited License to TigerLabel
You grant TigerLabel a limited license to:
- • Store, process, and transmit Your Data to provide the Services
- • Make backup copies for disaster recovery purposes
- • Create anonymized, aggregated analytics (not identifiable to you)
- • Use Your Data to improve AI models and features (opt-in only)
6.2 Your Responsibilities
You are responsible for:
- Ensuring you have the legal right to upload and process Your Data
- Obtaining necessary consents for processing personal data
- Complying with applicable data protection laws (GDPR, CCPA, etc.)
- Maintaining backups of critical data outside our platform
- Not uploading sensitive data without appropriate safeguards
6.3 Data Processing Agreement
If you process personal data using our Services, our Data Processing Agreement (DPA) applies. The DPA governs TigerLabel's role as a data processor and includes Standard Contractual Clauses for international transfers.
6.4 Data Deletion and Export
You may export Your Data at any time using our data export tools. Upon account termination, we will:
- • Provide you 30 days to export Your Data
- • Delete Your Data within 90 days of termination
- • Retain only what is required for legal or regulatory compliance
7Payment Terms
7.1 Subscription Plans
TigerLabel offers various subscription plans with different features and usage limits. Pricing is available on our Pricing page.
Billing Cycles
- • Monthly: Billed monthly in advance
- • Annual: Billed annually in advance (typically with discount)
- • Enterprise: Custom billing terms negotiated individually
7.2 Payment Processing
- Payments are processed securely through Stripe
- We accept major credit cards and ACH transfers (Enterprise)
- All fees are in U.S. Dollars unless otherwise specified
- You authorize us to charge your payment method for all fees
7.3 Automatic Renewal
Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current rate for your plan.
7.4 Usage-Based Fees
Certain features may incur additional usage-based fees (e.g., workforce labeling, API calls beyond included limits). You will be notified of such fees before incurring them.
7.5 Taxes
All fees are exclusive of taxes. You are responsible for all applicable sales, use, VAT, GST, and other taxes. We will add applicable taxes to your invoice unless you provide a valid tax exemption certificate.
7.6 Refunds and Credits
All fees are non-refundable except:
- • Within 14 days of first subscription purchase (Pro rata refund)
- • If we fail to meet our SLA commitments (Service credits)
- • At our sole discretion for extenuating circumstances
Payment Failures
If payment fails, we will attempt to charge your payment method multiple times. If payment remains unsuccessful for 15 days, we may suspend or downgrade your account. You remain responsible for any unpaid amounts.
8Service Level Agreement
8.1 Uptime Commitment

8.2 Exclusions
The SLA does not apply to downtime caused by:
- • Scheduled maintenance (with 48 hours notice)
- • Your misuse of the Services or violation of Terms
- • Third-party services or infrastructure
- • Force majeure events beyond our control
- • Beta or preview features
8.3 Support Response Times

9Limitation of Liability
Important Legal Notice
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TIGERLABEL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR DATA USE, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES.
TIGERLABEL'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO TIGERLABEL IN THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY.
9.1 Warranty Disclaimer
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TIGERLABEL DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9.2 Exceptions
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
10Indemnification
You agree to indemnify, defend, and hold harmless TigerLabel, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:
- Your access to or use of the Services
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Your Data or any content you submit or make available through the Services
- Any misrepresentation made by you
11Termination
11.1 Termination by You
You may cancel your subscription at any time from your account settings. Cancellation will be effective at the end of your current billing period. You will not receive a refund for any unused portion of your subscription.
11.2 Termination by TigerLabel
We may suspend or terminate your access to the Services immediately if:
- • You violate these Terms or our Acceptable Use Policy
- • Your account is inactive for more than 6 months (free plans)
- • Your payment is more than 15 days past due
- • We are required to do so by law
- • You engage in fraudulent or illegal activities
11.3 Effect of Termination
Upon termination:
- • Your right to access and use the Services immediately ceases
- • You have 30 days to export Your Data before it is deleted
- • We will delete Your Data within 90 days, except as required by law
- • You remain liable for any outstanding fees
- • Sections that by their nature should survive termination will survive
12Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in San Francisco County, California for the resolution of any disputes.
13Dispute Resolution
13.1 Informal Resolution
Before filing a formal dispute, you agree to first contact us at legal@tigerlabel.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.
13.2 Binding Arbitration
If we cannot resolve a dispute informally, any dispute arising out of or relating to these Terms or the Services shall be finally settled by binding arbitration under the rules of the American Arbitration Association (AAA). The arbitration will be conducted in San Francisco, California.
Class Action Waiver
YOU AND TIGERLABEL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
13.3 Exceptions
Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
